Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tavira Creator Academy platform (the "Service"), operated by Tavira ("we", "us", "our"). By accessing, claiming a model on, or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By creating a claim, you represent and warrant that you are 18 or older. We reserve the right to verify your age and identity via the KYC process described in Section 4 and to deny service to anyone who cannot or will not complete verification.

2. The Service

The Service allows verified creators to claim exclusive, one-of-one AI-generated model identities. Each claim entitles the creator to three high-resolution AI-generated images and a launch playbook PDF.

All models are generated entirely by prompt-to-image diffusion AI. No real person serves as reference or training subject for any model. Every face, body, and detail is synthesized from text prompts and is fictional.

3. Claims and Exclusivity

• Each model can be claimed by only one creator. Once claimed, the model is permanently retired from the public catalog.
• A claim becomes binding upon successful identity verification. Until KYC approval, the claim is held in reserved status and may be released if you fail verification.
• You may not transfer, resell, sublicense, or assign your claim to another party without our prior written consent.

4. Identity Verification (KYC)

To deliver your kit we require you to submit a government-issued photo ID and a selfie. We store these files in a private, access-controlled vault and use them solely to verify your identity and your eligibility. See our Privacy Policy for retention details.

5. License Granted to You

Upon successful claim and KYC approval, we grant you a non-exclusive (with respect to Tavira), perpetual, worldwide, royalty-free license to use, modify, and publish the images and playbook you receive for your own commercial creator activities, subject to the restrictions in Section 6.

6. Restrictions

You agree not to:

• Use the images to impersonate any real person.
• Combine the images with, or train any AI on, real-person likenesses without their consent.
• Use the Service or images for any illegal purpose, including the creation of CSAM, non-consensual intimate imagery, defamation, or fraud.
• Resell or redistribute the raw asset bundle to any third party.
• Reverse-engineer, scrape, or attempt to derive training data from the Service.

7. Takedowns & Compliance

Tavira complies with the U.S. TAKE IT DOWN Act (2025) and with all applicable non-consensual intimate imagery laws. Any individual who believes a model unintentionally resembles them, or that content on the Service violates their rights, may submit a removal request at /takedown. Valid requests are actioned within 48 hours.

8. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, submitted false verification information, or engaged in fraudulent behavior. On termination, your claims may be revoked and your license rights terminated.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any model image will achieve any specific commercial result for you.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will Tavira be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of your use of the Service. Our total cumulative liability shall not exceed one hundred U.S. dollars (US$100).

11. Indemnification

You agree to defend and indemnify Tavira against any claims arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights, including any misuse of the images you receive.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. We will revise the "Effective" date above and, where required by law, notify you by email. Continued use of the Service after changes take effect constitutes acceptance.
